Legal Sources
eg: Practice Acts, State Laws, Federal Laws.
Regulatory Services
eg: State and Federal agencies, Accrediation Organizations
Professional Organization and Associations
eg: ANA, AACN, AORN
Healthcare Facility Sources
eg: Policy & Procedures, Standards of Care Critical Pathways
Expert Testimony - The expert witness can also define SOC.
Customary practice is not a SOC
this practice may not demonstrate
what a good and / or reasonable
person would do. This practice
may not address new practices thus be negligent themselves.
SOC are extremly important in your case development. They can be utilized as demonstative evidence, cross examination of a witness.
Identify specific Policy and
Procedures of the defendent's health
care facility that should be in place
at time of incident.
Determine if healthcare provider followed the policy and procedure
in question.
Assess and Analyze the current SOC
against the policy and procedure of
the Healthcare institution, if they are not clear, concise, and accurate the plantiff can allege negligence
against the Healthcare facility.
